Telemedicine Consent

The Telemedicine Practice Guidelines, 2020 require that you understand and consent to being treated remotely. Under the Guidelines, your consent is implied when you start a teleconsultation yourself. This document explains what that consent covers, so please read it before your first consultation. It is always available in the app under Profile, All Legal Documents.
1. What I am consenting to
I am asking for a medical consultation delivered remotely, using the Swasthy platform, by a Registered Medical Practitioner registered with the National Medical Commission or a State Medical Council.
I understand the consultation may be conducted through text, through the exchange of images and documents, or by video call, as the doctor considers appropriate for my problem. I can join a video call with audio only.
I understand that the doctor may decide on what I send without speaking to me. When a doctor takes my case I may be asked to confirm my details, and the doctor may send me questions or call me by video. Some medicines need a video call at a first consultation. If I do not reply or answer, the doctor may decide on what I have sent, leave those medicines out, or advise me to be seen in person. I am shown the doctor's name, qualifications and registration number when they take my case.
2. I understand what remote care can and cannot do
I understand that:
- the doctor cannot physically examine me: the doctor cannot listen to my chest, palpate my abdomen, examine my ears or throat, or measure my blood pressure;
- the doctor works only from the information, images and documents I give in this consultation, my saved health profile, earlier Swasthy consultations I had with that same doctor, and details of any consultation this one follows;
- some conditions cannot be safely assessed remotely, and the doctor may conclude that I need an in-person examination or an investigation;
- there is a possibility that a remote consultation reaches a different conclusion than an in-person one would;
- a technical failure could interrupt or degrade the consultation.
I accept these limits.
3. I understand the role of artificial intelligence
I understand and consent to Swasthy using artificial intelligence to:
- convert my voice recording into text;
- translate my description of my symptoms into English, if the doctor asks for a translation;
- organise my symptoms into a structured summary;
- suggest the kind of doctor my case should go to, which I can change, and look for signs that I may need emergency care;
- prepare a draft assessment, a draft prescription and, if the doctor asks, suggested tests, all for the doctor to review.
I understand that the AI does not diagnose me and does not prescribe, that a Registered Medical Practitioner reviews and may change everything before signing, and that the doctor holds clinical responsibility for the final prescription.
I understand that the AI providers Swasthy uses are contractually barred from training their own models on my data.
I understand that Swasthy checks the AI used in my care for safety and accuracy as part of the service; that when I accepted Swasthy's Terms of Service and Privacy Policy, at sign-up or when they were updated, I also agreed that de-identified information from my consultations may be used to improve Swasthy's own AI, unless I had switched it off before; that I can switch it off at any time in Profile, Privacy & Data, and switching it off changes nothing about my care, my fee or my waiting time; and that my identifying details are removed first. Sections 6 and 6.1 of the Privacy Policy set out what is used and what is not.
4. I will give accurate information
I confirm that the information I give about my symptoms, medical history, current medicines and allergies will be true and as complete as I can make it. I understand that the safety of the prescription depends on it, and that withholding a medicine or an allergy can cause serious harm.
I understand the doctor may ask me to confirm who I am or my age, including on a video call.
I will tell the doctor if I am pregnant, may be pregnant, or am breastfeeding, by writing it in my symptom description, even if the app has already asked me.
5. I understand what cannot be prescribed
I understand that Indian law prohibits the prescribing of Schedule X drugs and the drugs on the Prohibited List, such as narcotics, psychotropics and other habit-forming medicines, through teleconsultation, and that these require an in-person consultation.
6. I will act on advice to be seen in person
I understand that if the doctor advises me to attend a clinic or hospital, to have a test, or to seek emergency care, I should do so promptly. I accept responsibility for acting on that advice.
I understand that Swasthy is not an emergency service and that in an emergency I should call 102 or go directly to the nearest hospital. If the app warns me that a symptom may be an emergency, I can still continue, but a doctor's review is not emergency care.
7. My data
I have read the Privacy Policy and I consent to Swasthy collecting and processing my personal and health data as set out in it, including:
- showing a summary of my case, including my name, to approved doctors on Swasthy before one of them accepts it, so they can decide whether to take it;
- sharing my consultation record with the Registered Medical Practitioner who accepts my case;
- processing my voice recording, transcript and clinical text through the AI providers listed in the Privacy Policy, including providers located outside India;
- retaining my prescription and consultation record for at least three years, as the Telemedicine Practice Guidelines and the National Medical Commission regulations require, even if I close my account.
I understand my consultation is confidential, that the doctor may not disclose anything that identifies me without my written consent except where the law requires it, and that I may withdraw my consent at any time, as section 11 explains. Withdrawal does not undo processing already carried out, and does not erase records the law requires to be kept.
8. Recording
I understand that Swasthy does not record video or audio calls.
I understand that the record of my consultation and the prescription are kept as described above. The words I typed, the transcript of my voice input and my uploaded images are kept with that record, but if I delete my account they are deleted, except as section 9 of the Privacy Policy explains.
I will not record or publish any part of the consultation without the doctor's written consent.
9. Fees and refunds
I understand any fee is payable before my case is offered to a doctor, that it is shown to me before I pay, and that refunds are governed by the Refund and Cancellation Policy.
10. This consultation is for me
I confirm that I am seeking this consultation for my own health, and not for a child or another person. I understand that Swasthy is currently for adults aged 18 and over consulting for themselves, that the prescription is issued in the name, age and sex on my account, and that a child needs to see a doctor in person.
11. My right to withdraw
I may cancel a consultation from the waiting screen at any time before a doctor accepts my case, for a full refund. After a doctor accepts my case I cannot cancel it in the app, as the Refund and Cancellation Policy explains, but I may decline any advice and seek a second opinion.
I may withdraw my consent to further processing of my data by writing to privacy@swasthy.ai or by deleting my account in Profile, Privacy & Data, and I can switch off AI improvement in the same place. Records the law requires are kept as described in section 7.
By starting a consultation on Swasthy, I confirm that this consent was available for me to read and that I agree to it. I can ask questions at support@swasthy.ai before I start.
