Swasthy Health Technologies Private Limited

These Terms govern your use of the Swasthy patient app and related services. By creating an account you agree to them. If you do not agree, do not use the Platform.
Please read Section 3, which explains what Swasthy is and is not, and Section 12, which explains the limits of our liability.
1. Who you are contracting with
Your agreement is with Swasthy Health Technologies Private Limited, a company incorporated in India ("Swasthy", "we", "us"). Our registered office, Corporate Identity Number and contact details are published in Contact & Company Information.
Swasthy AI, Inc. (United States) is our parent company and supplies technology to us. It is not a party to this agreement and does not provide healthcare services to you.
2. Who may use Swasthy
You may use the Platform if you are:
- at least 18 years old;
- physically present in India at the time of the consultation;
- able to enter into a binding contract under the Indian Contract Act, 1872.
Swasthy is currently for adults aged 18 and over, consulting for themselves. Please do not use your account for a child or another adult: prescriptions are issued in the name, age and sex on your account. A child needs to see a doctor in person. We will update these Terms before consultations for a dependant become available.
You must give accurate information about yourself and your health. The safety of a teleconsultation depends on it.
3. What Swasthy is, and what it is not
Swasthy is a technology platform that connects you to independent Registered Medical Practitioners and assists them with artificial intelligence.
- Swasthy does not practise medicine. We are not a hospital, clinic or medical practitioner. We do not diagnose, treat or prescribe.
- The doctor is independent. The Registered Medical Practitioner who reviews your case exercises their own clinical judgement and is solely responsible for the diagnosis and prescription they issue. They are not our employee, and we do not direct their clinical decisions.
- AI produces a draft only. Our artificial intelligence prepares a draft assessment and draft prescription. It has no authority to diagnose you or to prescribe. Every prescription is reviewed, amended as the doctor sees fit, and signed by a Registered Medical Practitioner who takes clinical responsibility for it.
- Swasthy is not an emergency service. Teleconsultation is unsuitable for medical emergencies. See Section 4.
- Swasthy is not a pharmacy. We do not sell, dispense or deliver medicines, and we have no commercial arrangement with any pharmacy that would influence what is prescribed to you.
- Swasthy is not a substitute for physical examination. Where an examination, an investigation or an in-person consultation is needed, the doctor will say so and you should act on it.

4. Emergencies
Do not use Swasthy in an emergency.
Call 102 for an ambulance, or go immediately to the nearest hospital emergency department, if you or anyone else has:
- chest pain, pressure or tightness
- difficulty breathing or shortness of breath at rest
- sudden weakness, numbness, drooping of the face, or difficulty speaking
- severe bleeding that does not stop
- a seizure, or loss of consciousness
- a serious injury, burn, poisoning or overdose
- severe abdominal pain, or a sudden severe headache unlike any before
- thoughts of harming yourself or another person
- in a child: high fever with a rash, seizure, unresponsiveness, or fast or laboured breathing
This list is not exhaustive. If you are unsure whether something is an emergency, treat it as one.
If you report a symptom that may be an emergency, the app warns you and offers to call 102. It may not spot every emergency, so do not wait for a warning. You can still continue, but a doctor's review is not emergency care and may take several minutes. If in doubt, call 102 first.
5. How a consultation works
- You describe your symptoms, in your language, by voice or by text.
- You give your medical history, current medications and allergies.
- You may attach photographs or documents.
- Our AI prepares a draft assessment and suggests a specialty, which you can change.
- You pay the consultation fee.
- We notify available Registered Medical Practitioners who match the specialty and language, or any available doctor if none match. Until one accepts your case, any approved doctor on Swasthy can see a summary of it, as our Privacy Policy explains. One doctor accepts it.
- The doctor reviews everything, may ask you to confirm your details or answer follow-up questions, and may call you by video, which you can join with audio only.
- The doctor signs a prescription or a lab test order with a message for you, or escalates your case to our team, for example because you need to be seen in person.
- You receive what the doctor signed in the app as a PDF.
We aim to complete this within about ten minutes. That is a target, not a guarantee. Times shown in the app are typical times, not promises. Availability of doctors varies by time of day, specialty and language.
If no doctor accepts your case within our service window, our team steps in to find you one while your case stays available to doctors. You may cancel for a full refund at any time before a doctor accepts, and if nobody has accepted within 2 hours we refund you automatically, as our Refund and Cancellation Policy explains.
6. Your responsibilities
You agree to:
- give complete and truthful information about your symptoms, history, medications and allergies;
- use the Platform for yourself only, and not for a child or another adult;
- tell the doctor if your condition worsens during the consultation;
- follow the doctor's advice, including any advice to seek an in-person consultation or emergency care;
- keep your account credentials and device secure, and tell us at once if you suspect unauthorised access.
You agree not to:
- impersonate another person, or create an account using someone else's identity;
- seek a prescription for anyone other than yourself;
- seek narcotic, psychotropic or other controlled substances, or misuse the Platform to obtain medicines for non-medical purposes;
- record, screenshot for redistribution, or publish a consultation or any part of it without the doctor's written consent;
- attempt to identify, contact outside the Platform, harass or abuse any doctor or member of our staff;
- scrape, reverse-engineer, disrupt or attempt unauthorised access to the Platform;
- upload malware, or content that is unlawful, obscene, defamatory or infringing.
We may suspend or terminate your account for a serious or repeated breach of this Section. Where the breach involves suspected fraud or misuse of controlled substances, we may report it to the appropriate authority.
7. Prescriptions
Prescriptions issued through Swasthy are electronic prescriptions signed by a Registered Medical Practitioner, and are valid for dispensing under the Telemedicine Practice Guidelines, 2020.
You should understand the following limits, which are set by law and not by us:
- Doctors on Swasthy prescribe only from the medicines permitted for teleconsultation: over-the-counter medicines (List O) in any consultation; medicines in List A at a first consultation only after a video call, and at a follow-up; and medicines in List B only at a follow-up, and only if that doctor has examined you in person for the same condition.
- Schedule X drugs and the drugs on the Prohibited List cannot be prescribed by teleconsultation at all. This includes narcotics, psychotropics and other habit-forming and high-risk drugs. Doctors on Swasthy may not prescribe them by teleconsultation, and the app blocks the medicines on those lists that it recognises. Asking for them will not change that.
- Schedule H and H1 medicines are prescribed only where the doctor judges it clinically appropriate and permitted for teleconsultation, and a pharmacist will record the dispensing in the register the law requires.
- A prescription is issued for the episode described, to the person described. It is not transferable and must not be reused for a later illness.
A pharmacist may refuse to dispense against any prescription if it appears altered, incomplete or clinically inappropriate. That is their professional duty and we support it.
Once signed, a prescription cannot be edited. If you think it has an error, email support@swasthy.ai straight away with the consultation date. We ask the issuing doctor to review it and tell you the outcome. If the doctor finds an error, we tell you to stop using that prescription and what to do next.
8. Fees and payment

Fees are inclusive of applicable taxes. They are current as at the effective date of these Terms and may change; the fee shown to you in the app before you pay is the fee that applies to that consultation.
Where a fee applies, payment is taken before your case is offered to a doctor, through our payment gateway. We do not store your card, UPI PIN or banking credentials.
The follow-up rate applies when you tell us your new consultation is about the same problem as a completed consultation you started in the last 14 days, and you choose the same doctor. We notify that doctor if they are available, but another doctor may review it at the same rate. Otherwise, a new consultation is charged at the standard rate. For a lab report review we also notify your doctor if they are available, and another doctor may review it.
9. Refunds
Refunds are governed by our Refund and Cancellation Policy, which forms part of these Terms. In summary: you are refunded in full if you cancel from the waiting screen before a doctor accepts your case, if nobody accepts it within 2 hours, if a technical failure on our side prevents the consultation, or if you are charged twice. Once a doctor accepts your case, you cannot cancel it in the app, and a consultation completed after a longer wait is still a delivered consultation. A consultation that has been delivered, where a doctor has reviewed your case and signed a prescription or a lab test order, is not refundable merely because you disagree with the outcome. Other refund requests go by email to billing@swasthy.ai and are checked before they are decided.
10. Your data
Our handling of your personal and health data is governed by our Privacy Policy. By using the Platform you confirm that you have read it.
You retain ownership of the health information you provide. You grant Swasthy a licence to process it for the purposes set out in the Privacy Policy: providing the consultation, checking that the AI used in your care is safe and accurate, maintaining the medical record, meeting our legal obligations, and, in de-identified form, improving Swasthy's own AI as described in Section 6.1 of the Privacy Policy. When you accept these Terms and the Privacy Policy, at sign-up or when they are updated, you also agree to that last use, unless you have switched it off before. You can switch it off at any time in Profile, Privacy & Data without affecting your care.
Prescriptions and consultation records are retained for at least three years, as the Telemedicine Practice Guidelines and the National Medical Commission regulations require, even if you close your account.
11. Availability of the service
We aim to keep the Platform available at all times but do not guarantee uninterrupted service. We may suspend it for maintenance, and we will give notice where we reasonably can.
We may modify or discontinue features. If we discontinue the Platform entirely, we will give at least 30 days' notice and make your prescriptions and consultation records available to you before we do.
12. Limitation of liability
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, for fraud, or under the Consumer Protection Act, 2019.
Subject to that:
- Clinical liability rests with the treating doctor. Swasthy provides the platform. The diagnosis and prescription are the professional acts of the Registered Medical Practitioner who signed them, and professional liability for them is theirs. Every doctor on the Platform agrees in their contract with us to hold professional indemnity insurance.
- Swasthy is not liable for harm resulting from information you gave that was incomplete or inaccurate, from your failure to follow the doctor's advice, or from your delay in seeking emergency care.
- Swasthy is not liable for the acts of a pharmacy, laboratory or hospital you attend, which are independent of us.
- We are not liable for indirect or consequential loss, or for loss of profit, income or opportunity.
- Where our liability is not otherwise excluded, our aggregate liability to you for all claims arising out of a consultation is limited to five times the fee you paid for that consultation.
These limits apply to the maximum extent permitted by Indian law.
13. Indemnity
You agree to indemnify Swasthy against loss arising from your breach of these Terms, from information you gave that you knew to be false, or from your use of the Platform to obtain medicines by deception.
14. Suspension and termination
You may close your account at any time from Profile, Privacy & Data, Delete my account, or by emailing privacy@swasthy.ai, as our Delete Your Account page explains.
We may suspend or terminate your account if you materially breach these Terms, if we are required to by law, or if we reasonably suspect fraud or a threat to the safety of a doctor or another user. Except where the law prevents us, we will tell you why.
On termination, Sections 7, 10, 12, 13 and 17 survive.
15. Grievances
If something goes wrong, tell us. Our Grievance Redressal Policy sets out how to complain, and commits us to acknowledging within 24 hours and resolving within 15 days.
Grievance Officer: grievance@swasthy.ai. The officer is named, with postal address and phone, in Contact & Company Information.
You may also complain to the National Medical Commission or the relevant State Medical Council about a doctor's professional conduct, to a consumer forum under the Consumer Protection Act, 2019, or to the Data Protection Board of India about data protection.
Nothing in these Terms requires you to come to us first before exercising a statutory right.
16. Changes to these Terms
We may amend these Terms. Material changes are shown in the app and sent as a notification at least 14 days before they take effect. Where a change needs your agreement, we ask you to accept it in the app. If you do not accept the amended Terms, you may close your account.
17. Governing law and disputes
These Terms are governed by the laws of India.
We ask that you raise any dispute with our Grievance Officer first, so that we have a chance to fix it. If it cannot be resolved that way, the courts at the seat stated in Contact & Company Information have exclusive jurisdiction. As a consumer, however, you retain every right to approach the consumer forum having jurisdiction where you reside.
18. General
If any provision of these Terms is held unenforceable, the rest continues in force. Our failure to enforce a provision is not a waiver of it. You may not assign your rights under these Terms; we may assign ours to a successor entity on notice to you.
These Terms, together with the Privacy Policy, Medical Disclaimer, Telemedicine Consent, Refund and Cancellation Policy and Grievance Redressal Policy, are the entire agreement between you and Swasthy.
